AAAtraq’s ADA audit finds 87% of Restaurant websites in California are not Inclusive and exposed to litigation.

Apr 26 2022

[APRIL 26, 2022 CALIFORNIA] In the latest report, released today by InsurTech, AAAtraq https://AAAtraq.com/ (opens in a new window) it was revealed that almost 9 out of 10 California restaurants’ websites are non-complaint with the Americans with Disabilities Act (ADA), leaving them exposed to the risk of litigation by opportunistic lawyers.

The report is aimed at raising awareness to the fact that websites, like buildings, are subject to the ADA and need to similarly accommodate. Whilst restaurant owners and operators do not intentionally discriminate – the report concludes that the vast majority are doing just that.

Working together with Wilson Elser, https://www.wilsonelser.com/ (opens in a new window), a leading national law firm with a wealth of digital and ADA litigation experience, and in partnership with the Californian Restaurant Association, https://www.calrest.org/ (opens in a new window), AAAtraq seeks to improve inclusion for the internet user, and protect restaurant owners and operators from unnecessary litigation.

The report also provides insight as to why ADA compliance for websites has proved to be so elusive for restaurants, despite billions being spent, and concludes that too much faith is being put in website vendors that promise compliance.

“Getting the right contracts in place with vendors is critical”, said Bruno Katz, Partner at Wilson Elser, and who serves on several hospitality industry boards and associations, “It is critical for restaurants to ensure that every vendor it uses agrees to comply with the ADA and indemnifies restaurants for its failures.”

Michael Doerr, Chief Operating Officer at California Restaurant Association said “Website ADA compliance is a growing and real risk for restaurants in California. Recognizing the need for a proactive, ongoing process to identify website compliance issues is an essential step in serving your guests when they are online and protecting your organization from the recent onslaught of ADA claims facing the restaurant industry.”

Concluding, Lawrence Shaw of AAAtraq added “Restaurant owners naturally want to get the ADA problem off their plate. The first step is to understand your current exposure. To facilitate this, AAAtraq provides a free audit service, to check the inclusion status of any website in 60 seconds or less. The simple color coding: red is bad, green is good, makes your position easy to understand without getting into technicalities.”

About California Restaurant Association https://www.calrest.org (opens in a new window)

The California Restaurant Association promote and protect industry interests and practices through aggressive lobbying, monitoring the legislative process, initiating grassroots campaigns, boosting political action committees, and fighting for policies that support the industry at all levels of government. By eliminating damaging public policy before it becomes law, our team’s ongoing efforts have already saved the restaurant industry hundreds of millions of dollars. High labor costs, increased exposure to liability and low profit margins in a highly competitive environment leave restaurateurs particularly vulnerable to bad public policy.
